As the old saying goes, “The young lawyer knows the law, but the old lawyer knows the Judge”.

THE POLICE IN KERN COUNTY ARE OFTEN BRUTAL AND ARE INSTITUTIONALLY DISHONEST.

Kern County police agencies have a longstanding history of brutality and unjustified homicides by Kern County Sheriff’s Office deputies and by other Kern County police agencies. See, ‘The Killing County’: How policing in one California county became notorious for its alleged brutality, ABC News, February 3, 2023 (Hulu series controversy over the police force in Kern County and the trail of killings in their wake).

Of the 32 Officer Involved Shootings of civilians by Kern County Sheriff’s Office deputy sheriffs, all of them were found to be justified and within Kern County Sheriff’s Office policy. See, Kern County Sheriff’s Office Critical Incident Videos. It’s not surprising that the Kern County Sheriff’s Office has never seen an Officer Involved Shooting that it didn’t like. That is the mentality in Kern County.

Aside from Kern County Sheriff’s Office unjustified shootings of civilians, the Kern County Sheriff’s Office also has a well-earned reputation for beating or tasing or pepper-spraying, and falsely arresting and maliciously prosecuting innocents in “Contempt of Cop” situations. See, The “Contempt of Cop Game”; How Well Can You Play?, steeringlaw.

Kern County Sheriff's Deputy siccing dog on man 2Contempt of Cop” situations arise when the police treat civilians poorly, and the offended civilians verbally protest or verbally challenge police actions or orders. Verbal protest or verbal challenge of police actions or orders has long been held to be constitutionally protected conduct. See, City of Houston v. Hill, 482 U.S. 451 (1987) (“The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.”)

However, in the real world with real police with real fragile egos, verbal protest or verbal challenge of police actions or orders will more than likely result in you getting beaten or tased or pepper-sprayed, and falsely arrested and maliciously prosecuted for some fabricated “resistance offense” such as violation of Cal. Penal Code § 69 (resisting officer with force), Cal. Penal Code § 148(a)(1) (resisting/delaying/obstructing a officer), Cal. Penal Code § 240/241 (assault on officer), Cal. Penal Code § 242 / 243(b) & (c) (battery on officer causing injury) and Cal. Penal Code § 245(c) (assault on officer with weapon).
