As Chief Justice John Marshall stated in 1803 in America’s landmark case of Marbury v. Madison, 5 U.S. (1 Cranch) 137 (1803): “It is a general and indisputable rule that where there is a legal right, there is also a legal remedy by suit or action at law whenever that right is invaded.” The converse of that proposition by Chief Justice Marshall is equally true; where there is no real and practical remedy for violation of your constitutional rights, then no such constitutional rights exist in the real world. In the real world, you only have constitutional right to the extent that you can enforce them. In the real world, the only way that you can enforce your constitutional rights, is to have 8 mostly white, mostly conservative, mostly cop-loving jurors unanimously vote for you and condemn the police in your police misconduct civil rights trial in federal court. It doesn’t matter what the law says, or what the judge says, or what the jury instructions say, if for whatever reason, 8 mostly white, mostly conservative, mostly cop-loving jurors will not unanimously vote for you and condemn the police in your civil rights trial against the police.
