The Mentone neighborhood of San Bernadino County is patrolled by the San Bernardino County Sheriff’s Department. Mentone also has its problems with out-of-control San Bernardino County Sheriff’s Department deputy sheriffs. San Bernardino County is the largest geographical county in the contiguous United States, approximately 20,105 square miles, with an estimated population of 2,300,000 residents. Accordingly, it’s difficult for the command staff at the San Bernardino County Sheriff’s Department to closely supervise and to scrutinize its 2,000 sworn deputies.

California peace officers are only required to graduate from a six-month Police Academy to become certified California peace officers. However, Fourth Amendment search and seizure law is extremely subtle and complicated. Accordingly, most California peace officers (i.e. deputy sheriffs and police officers) have a very basic understanding of Fourth Amendment search and seizure law, but not a learned and sophisticated understanding of that subject.

This author has deposed literally thousands of California peace officers, and with almost no exceptions, none of them has ever actually read a case issued by the United States Supreme Court, or the United States Court of Appeals for the Ninth Circuit, or a California Supreme Court case, or even a California Court of Appeal case. Ergo, none of them really understand the subtleties of Fourth Amendment search and seizure law, and both California peace officers and the California citizenry.

When that happens, the protesting civilian often ends up being beaten or tased or pepper-sprayed, or even shot, and thereafter falsely arrested and maliciously prosecuted for some fabricated “resistance offense” such as violation of Cal. Penal Code § 69 (resisting officer with force), Cal. Penal Code § 148(a)(1) (resisting/delaying/obstructing officer), Cal. Penal Code § 240/241 (assault on officer), Cal. Penal Code § 242 / 243(b) & (c) (battery on officer causing injury) and Cal. Penal Code § 245(c) (assault on officer with weapon). This is not lefty propaganda; this is reality.
