Calexico Police SWATDue to Calexico’s population being 97.3% who identify as Hispanic or Latina, it’s difficult to claim that the Calexico Police Department racially profiles Mexicans; they’re basically all Mexicans / Mexican Americans in Calexico. However, like other cities with different demographics, most of the time that Calexico Police Department police officers beat-up or tase or pepper-spray or falsely arrest civilians are in the context of “Contempt of Cop” situations. These “Contempt of Cop” situations involve civilians verbally protesting or verbally challenging police orders or actions. That type of conduct is constitutionally protected. See, City of Houston v. Hill, 482 U.S. 451 (1987) (“The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.”)

Americans tend to think that they “know their rights”, and in reality, they do not have the slightest idea what their First Amendment and Fourth Amendment rights really are, as they are not lawyers or constitutional scholars, and those constitutional issues are very complicated and subtle.

Such verbal remonstrance often, therefore, results in such police officers beating-up or tasing or pepper-spraying or falsely arresting those protesting / challenging civilians.

The best practice in the real world with real police officers and real judges and real juries, is to shut your mouth, be polite with the officer and do what they tell you to do. This is the key to later successfully suing the police in court and actually winning. A right only exists if there is a real world remedy to enforce that right, and if you cannot convince a federal court civil jury to unanimously vote for you when you sue the police, then you have no rights because you have no way to enforce them.

Just because the police violated your constitutional rights doesn’t mean that you can do anything about it. You need a unanimous jury of usually 8 jurors to vote in your favor in federal court to win your case. If you mouth-off to the cops or don’t do what the police tell you to do or cuss out the cops, or act like a jerk, one or more of the jurors in your case may not vote for you. That is the reality in which we all live.
