As the old saying goes, “The young lawyer knows the law, but the old lawyer knows the Judge”.

THE SEAL BEACH POLICE DEPARTMENT IS OFTEN A BRUTAL AGENCY AND IS INSTITUTIONALLY DISHONEST.

Like other modern police agencies, the Seal Beach Police Department takes no chances with their safety, no matter how outrageous the precautions that they take to ensure their safety results in beatings, shootings and other outrages against the public. See, Officer’s Safety Has Replaced Probable Cause, steeringlaw.

LAPD Batting Practice in the ParkIn that regard recently two Seal Beach police officers fatally shot an armed 47-year-old Irvine man outside the home of a woman who had filed a restraining order against him when that shooting was clearly unjustified. Notwithstanding the obvious wrongfulness of that shooting, as usual, the Orange County District Attorney’s Office found no fault with that shooting. See, Officers in Seal Beach’s first fatal police shooting in 20 years cleared by D.A.’s office, Los Angeles Times, January 4, 2024.

Moreover, the Seal Beach Police Department has had a longstanding history of brutality and false arrests. See, Seal Beach Police Department: Lawsuit Alleges Evidence Planting and Corruption, LA Weekly, January 4, 2011. See also, Seal Beach Hit With Racketeering Suit : Law enforcement: The action, filed in federal court, accuses the Police Department of having a quota system for arrests and citations. Los Angeles Times, July 2, 1991. See also, Jack Pelenty v. City of Seal Beach, No. 12-57076 (9th Cir. 2014) (officers conspire to frame plaintiff for attempted murder).

Most of the times when Seal Beach Police Department police officers beat or tase or pepper-spray, and falsely arrest and procure the malicious criminal prosecutions of innocents is in the context of “Contempt of Cop” situations.

Justice William Brennan Jr.Contempt of Cop” situations involve civilians verbally protesting or verbally challenging police actions or orders. Many cops have fragile egos, and when the police act aggressively or otherwise unreasonably toward persons who they accost, many innocents verbally protest or verbally challenge the way that they are being treated. Such verbal protest or verbal challenge has long been held to be constitutionally protected conduct: “The freedom of individuals verbally to oppose or challenge police action without thereby risking arrest is one of the principal characteristics by which we distinguish a free nation from a police state.” Houston v. Hill, 482 U.S. 451 (1987), Brennan, J.

However, in the real world, when the civilian is now deemed to be in “Contempt of Cop“, and the police will often then beat or tase or pepper-spray, and falsely arrest and procure the malicious criminal prosecutions of those innocent civilians for some fabricated “resistance offense”, such as violation of Cal. Penal Code § 69 (resisting officer with force), Cal. Penal Code § 148(a)(1) (resisting/delaying/obstructing a officer), Cal. Penal Code § 240/241 (assault on officer), Cal. Penal Code § 242 / 243(b) & (c) (battery on officer causing injury) and Cal. Penal Code § 245(c) (assault on officer with weapon).

This is not lefty propaganda. This is reality.
