Mr. Rackauckas did not understand how gullible Orange County juries are to police excuses for the unaccusable and believed that the beating of Kelly Thomas was so outrageous that even an Orange County Superior Court jury would understand that police officers are not trained to beat civilians to death. He miscalculated that equation. A Fullerton Police Department Corporal who teaches use of force to Fullerton police officer testified that he saw nothing wrong with the officers’ conduct in beating Kelly Thomas to death with their bare hands, and the Orange County Jury was gullible to believe him. What the Kelly Thomas case demonstrates is that “excessive force” is more of a political concept than a factual one, and that people who believe that the police are basically honest people with a difficult job and have a few “bad apple” officers will not see evil when its obvious and right in front of their face.
