As the old saying goes, “The young lawyer knows the law, but the old lawyer knows the Judge”. ONTARIO POLICE ARE NOT YOUR FRIENDS WHEN THEY THEIR INTERESTS CONFLICT WITH YOURS. IN THE REAL WORLD, BATTERY ON A PEACE OFFICER IS BATTERY BY A PEACE OFFICER. The Ontario Police Department is no different that other modern California police agencies. Ontario PD is often a very cruel and brutal entity; not always. Police agencies are not homogeneous, and they have good cops, bad apple cops, and everything in between. However, in the end, none of these categories of police officers will “rat-out” their fellow officers. None of them will tell the truth, under oath or otherwise, against a fellow officer, lest they be branded as a “rat” who will one way or another get eventually run out of that police agency. Ontario Police Department officers often falsely arrest, beat, shoot and even kill anyone they care to. This is no joke, this is reality. They have a long history of falsely arresting, beating and killing innocents. One would think that as the Ontario Police Department now uses Body Worn Cameras that their incidents of outright brutality / excessive force and false arrests of innocents would diminish. However, that has not happened. There is almost no limit what they will do to protect themselves from the victims of their outrages. They beat, falsely arrest and procure the malicious criminal prosecutions of their victims, and the San Bernardino County District Attorney’s Office has been, and remains all too willing to help the violating police officer and their employing agencies to beat-down their victims and protect them from civil liability by falsely criminally prosecuting them for various “resistance offenses”, such as as violation of Cal. Penal Code § 69 (resisting officer with force), Cal. Penal Code § 148(a)(1) (resisting/delaying/obstructing a officer), Cal. Penal Code § 240/241 (assault on officer), Cal. Penal Code § 242 / 243(b) & (c) (battery on officer causing injury) and Cal. Penal Code § 245(c) (assault on officer with weapon). JERRY L. STEERING’S SUCCESS AGAINST THE ONTARIO POLICE DEPARTMENT AND OTHER POLICE AGENCIES IN SAN BERNARDINO COUNTY. Matthew Krechmery called Ontario PD for help when his now ex-wife who was separated and was living separately from him at that time, barged into his separate home and went after his girlfriend to attack her in his upstairs bedroom. When the responding Ontario Police Department officers arrived at Mr. Krechmery’s condo, he was holding his crazed now ex-wife down on the floor at the foot of the stairs. Mr. Krechmery let go of his ex-wife and surrendered to the officers. Rather than simply handcuffing the now surrendering Mr. Krechmery, the Ontario Police Officers simply pistol whipped him; hard enough to dislodge the clip plate from the officer’s gun and causing the bullet’s from the gun falling out on the floor, all of which was captured on the officer’s Body Worn Camera video. Many years earlier, Mr. Steering successfully defended James Lemoine on bogus criminal charges of assault on an Ontario Police officer. An Ontario Police Officer located Mr. Lemoine in a neighbor’s home after incident with his girlfriend, resulting in her called police on him. Mr. Lemoine attempted to flea the officer and attempted to jump through window of home to escape. Mr. Lemoine got stuck in the window sill assembly, and was shot in the back by the Ontario Police Department officer while in that position. He posed no threat to the officer, who was exonerated of wrongdoing by Ontario PD (“What’s wrong with shooting an unarmed man, stuck in a window frame, cut-up, with one leg outside and one leg inside?”) The officer claimed that Mr. Lemoine attacked him in an effort to escape; a complete fabrication that the jury did not buy. Result, Hon. Ben T. Kayashima, Judge Presiding: Jury Verdict: Not Guilty all Counts.
