Penal Code § 245(c) (assault on officer with weapon).

Recently, Montclair Police Department officers responded to a home in 4100 block of Mission Boulevard after a 911 call was made around midnight about a man armed with an object. The caller told police that Ibañez appeared to be under the influence of drugs.

According to the family and their team of lawyers, Montclair police officers came in and used a Taser and batons to detain Ibañez, killing him. The family claims it was “simply a call for assistance” and no one was in danger. These calls for service that result in the police beating a mentally ill person to death these days result from today’s police taking no chances at all regarding any possible threat to them.

If the police want to arrest someone in a private residence who refuses to come outside, rather than enter the house with bullet-proof shields and Kevlar helmets and machine guns, these days the police just bulldoze the walls in the house down to expose the hiding suspect / warrant target; no joke.

Rather than try to diffuse a situation where a mentally ill person is holding an object that could possibly be used as a weapon, they just shoot them. Again, this is not an exaggeration.
