As Chief Justice John Marshall stated so eloquently in the landmark case that established the right of the Supreme Court to declare acts of Congress or of the Executive branch of Government Unconstitutional:

“It is a general and indisputable rule that where there is a legal right, there is also a legal remedy by suit or action at law whenever that right is invaded.” Marbury v. Madison, 5 U.S. 137 (1803).

Most Police Misconduct Civil Rights Cases involve the police violating your federal constitutional rights, such as the right to be free from a false arrest (U.S. Const. Amendment 4), your right to be free from the use of excessive force (U.S. Const. Amendment 4), your right to be free from a malicious criminal prosecution (U.S. Const. Amendment 4 & 14th Amendment), and your right to freedom of speech (U.S. Const. Amendment 1). Therefore, most Police Misconduct Civil Rights Cases end up in federal court.

Under the 7th Amendment to the United States Constitution, both sides to a civil case in federal court have a right to a trial by jury if the amount sued for exceeds $20.00. Also, in federal court in a civil case, there has to be a unanimous verdict. Fed. Rules Civil Proc. 48.

Accordingly, in order to enforce your federal constitutional rights, you need to be able to persuade a unanimous jury to vote for you and to condemn the police. If you cannot achieve that, then you have no federal constitutional rights, because in the real world of cop-loving jurors, you cannot win your case.
