Moreover, all 8 jurors will decide the case, and their verdict has to be unanimous either way (Fed. Rule Civil Proc. 48(b)). In addition, the Judge, rather than the lawyer, conducts almost all of jury questioning (Fed. Rule Civil Proc. 47). Any prospective jurors who do not believe that the police are basically honest people with a tough job with a few bad apples, never make it to sit on your jury in federal court. The District Judge will either excuse for cause any prospective juror who does not worship the police, or the lawyers for the defendant police officers will use their three peremptory jury challenges to keep them off of your jury. Therefore, if you cannot get those 8 cop-loving jurors to unanimously vote for you in a real trial in federal court, you have no rights, because you cannot enforce them.
